Use of withdrawn or expired forms is in violation of the copyright. It is a violation of the Missouri law to use forms for which the approval has been withdrawn. The association will not defend the use of withdrawn or expired forms. Generally E&O insurance policies require the use of current approved forms.

2. REVISED Paragraph 5 Closing and Possession-2043 Special Sale & 2090 Residential Sale Contracts Version 07/21 Valid; Version 01/20 expires 12/31/21:
   The contract defines the “Closing” as the exchange of the Seller’s deed for total purchase price. There are instances when the Seller does not receive their proceeds on the day of closing due to the late time in which their title company sent the wire or due to normal built-in delays with the Federal Reserve wiring process. In these cases, the Seller could feel that Closing has not occurred and may want the buyer possession delayed until they have received their proceeds. The seller could go to the title company to pick up their proceeds but in some cases request a wire instead. These revisions eliminate the argument and specifies a reasonable solution to last-minute disputes.
